Litigation

Suing or being sued? Instruct Kelly & Partners.

Kelly & Partners lawyers have substantial experience conducting major litigation as instructing solicitor and/or counsel (barrister) including trials before the Supreme Court, Federal Court, Federal Circuit Court and Family Court, and appeals to the Court of Appeal, Full Court of the Federal Court and the High Court of Australia.

Some of our lawyers have also taught civil practice and procedure for over 20 years to a generation of law students at Charles Darwin University. A thorough understanding of the rules and procedure is essential to effective and efficient conduct of civil litigation. Instructing Kelly Partners to represent you in litigation may be just what your case needs to give you the winning edge.

In particular, our lawyers have wide experience in administrative law, the branch of civil law under which citizens are able to challenge decisions of government agencies at all levels where those decisions affect them adversely e.g. decisions about pensions and benefits; liquor gaming and other licences and permits; and migration and taxation decisions to name just a few categories of decision that may have a drastic effect on people’s lives. In 2021 Kelly & Partners had carriage of the mandatory vaccine case brought by United NT Businesses against the Chief Health Officer and the NT Government (Phillips v CHO). Our case was so strong with the help of Professor Nikolai Petrovski and barrister Julian Burnside QC AO, that the government responded by enacting retrospective legislation to over-ride our case just three weeks before the trial was to begin.
